Introduction

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you”) and W Interactive AB, Swedish registration number 559521-1821, with address Falsterbovägen 8, 121 52 Stockholm, Sweden (“Company,” “we,” “us,” or “our”), concerning your access to and use of the MindLog mobile application (the “App”) and any related services (collectively, the “Services”).

By accessing or using the Services, you agree to abide by these Terms. If you do not agree with any part of these Terms, you must discontinue use immediately.

1. Description of Services

MindLog is a privacy-first digital journaling application that provides end-to-end encrypted journal entry creation and storage, cross-device synchronization, optional AI-powered features, and data export capabilities.

2. User License and Restrictions

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial use. You may not use the Services to violate laws, share illegal content, infringe intellectual property rights, or attempt to breach our security.

3. Subscription and Payment Terms

Certain features require a paid subscription. Fees and billing cycles are managed through the Apple App Store or Google Play. Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends. Refunds are processed according to the policies of the respective app store.

4. User Content and AI Processing

You retain full ownership of your journal content. If you enable optional AI features, you grant us a limited license to process decrypted excerpts of your content solely to provide the feature. This data is not used to train AI models. We do not claim copyright over any AI-generated content.

5. Privacy

W Interactive AB is the data controller for your personal data. Our data processing practices, your rights, and other details are explained in our Privacy Policy, which is an integral part of these Terms.

6. Security and Encryption

Your journal content is protected by end-to-end encryption (AES-256-GCM). You are responsible for maintaining your account credentials and device security. Due to the nature of the encryption, we cannot recover your data if you lose your password, and we are not liable for unauthorized access resulting from a compromise of your device.

7. Third-Party Services

We use third-party service providers to operate the Services. Please see our Privacy Policy for details on data processing and sharing.

8. Age Requirements

You must be at least 13 years old, or the minimum age required in your country to consent to data processing, whichever is higher. Where required by law, users below the age of digital consent may need parental consent.

9. Service Availability and Modifications

We may modify or discontinue the Services with reasonable notice. We are not liable for service interruptions caused by circumstances beyond our reasonable control (force majeure).

10. Account Termination

  • By You: You may terminate your account at any time.
  • By Us: We may terminate accounts for violations of these Terms.
  • Data After Termination: Following account deletion, we aim to delete all personal data from our active systems, typically within 30 days. Encrypted backups may be retained for a short additional period for recovery purposes before being permanently deleted.

11. Liability and Disputes

  • Liability: To the extent permitted by law, our liability is limited. Nothing in these Terms limits statutory consumer rights or liability for negligence, fraud, or willful misconduct.
  • Governing Law: These Terms are governed by Swedish law.
  • Dispute Resolution: For EU consumers, disputes may be brought in your local courts or the Stockholm District Court. The Swedish Alternative Dispute Resolution body is Allmänna reklamationsnämnden (ARN).
  • Class Action Waiver: For U.S. users only, you agree to resolve disputes individually.

12. General Provisions

We may update these Terms and will notify you of significant changes. If any provision is found unenforceable, the remainder of the Terms remains in effect. Provisions regarding liability, disputes, and intellectual property survive termination.
